1. Acceptance
By creating an Afya Hub account, signing in, or otherwise using the Afya Hub mobile application or the Afya Hub web portal at macwishmedicalcentre.co.tz (together, the “Service”), you accept these Terms & Conditions (the “Terms”) and our Privacy Policy. If you do not accept them, please do not use the Service.
2. Who we are
The Service is operated by MacWish Medical Centre, a Polyclinic in Mwanza, Tanzania (the “Centre”, “we”, “us”). Afya Hub is the Centre’s proprietary digital healthcare platform — the mobile application is available on the Apple App Store and Google Play Store in Tanzania, and the web portal is accessible at macwishmedicalcentre.co.tz. The platform was developed by MacWish AfyaHub, our dedicated research and development entity, exclusively for MacWish Medical Centre and its registered patients and clinical staff.
Patient data is hosted primarily in Tanzania through our partnership with the National Internet Data Centre (NIDC), Dar es Salaam, in compliance with the Tanzania Data Protection Act.
3. Eligibility
- You must be at least 18 years old to register your own account.
- A parent or legal guardian may enrol and manage dependants under 18 through the Family Care Plan, subject to applicable Tanzanian law.
- Doctors, nurses, and other clinical staff must hold valid registration with the relevant Tanzanian professional council (e.g. the Medical Council of Tanganyika — MCT) and must keep that registration current. We verify MCT credentials before granting service-provider permissions; accounts with lapsed or unverifiable registrations are placed in a pending-verification state and may be suspended.
- You must have a valid Tanzanian phone number to register.
4. Your account
- You agree to provide accurate, current, and complete registration information.
- You are responsible for keeping your sign-in credentials — including any biometric authentication configured on your device and any passkey or WebAuthn credential registered on the web portal — confidential and secure.
- You agree to notify us promptly at info@macwishmedicalcentre.co.tz if you suspect unauthorised access to your account.
- One person, one account. Sharing accounts is not permitted. Family members must each have their own account or be enrolled as a dependant through the Family Care Plan.
- Your account is identified by a unique patient code, which is also encoded in a Code128 barcode on your hospital ID card. This barcode is a convenience identifier for clinic check-in; possession of the barcode does not grant any person access to your medical records.
5. Medical disclaimer
Afya Hub does not provide emergency medical services. If you are experiencing a medical emergency, call 112 immediately or go to the nearest emergency department.
Information returned by our AI assistants Dorah and Nyamizi, and content displayed in the app or portal generally, is provided for informational purposes and does not constitute a medical diagnosis, prescription, or treatment plan. A qualified, registered clinician is solely responsible for any decision about your clinical care.
Vital-signs readings recorded through Afya Hub are intended to support clinical consultations, not to replace them. Abnormal readings should be discussed with your clinician.
6. Acceptable use
You agree not to:
- Misrepresent your identity, professional qualifications, or your relationship to a dependant.
- Upload, transmit, or display content that is unlawful, defamatory, harassing, obscene, or that infringes another person’s intellectual property or privacy rights.
- Attempt to access, view, copy, or modify another user’s account, clinical record, consultation history, or referral letter.
- Probe, scan, fuzz, or test the vulnerability of the Service, or attempt to circumvent any authentication, authorisation, rate-limiting, or security control.
- Use the Service to provide medical advice, prescriptions, or diagnoses for which you are not lawfully licensed.
- Re-sell, sublicense, or redistribute any part of the Service or its content without our prior written permission.
- Introduce malware, viruses, or any code designed to damage, disrupt, or gain unauthorised access to any system.
7. Your security obligations
Because Afya Hub holds sensitive medical data, you accept specific security obligations when using the Service:
- Biometric authentication. If you enable fingerprint or Face ID on the mobile app, ensure that only your own biometric credentials are enrolled on the device. Do not enrol another person’s biometrics on a device you use for Afya Hub.
- Passkeys & WebAuthn (web portal). If you register a passkey for the web portal, treat the associated device or hardware key as you would a physical key to a medical record — keep it secure and revoke it promptly if lost or compromised, via Settings → Security → Manage passkeys.
- Shared devices. Do not access Afya Hub on a shared or public device. If you do, sign out immediately after your session and clear browser storage. We cannot be held responsible for unauthorised access resulting from your failure to sign out.
- Suspected breach. If you believe your account has been compromised, contact us immediately at info@macwishmedicalcentre.co.tz and change your credentials without delay.
8. Appointments, teleconsultations, and home visits
Bookings made through the Service constitute a request to MacWish Medical Centre and the relevant clinician. A booking confirmation does not by itself create a doctor-patient relationship; that relationship begins when the consultation commences.
In-person appointments may be booked for available doctors at MacWish Medical Centre using the Afya Hub mobile app or web portal. You will receive a push-notification reminder before your appointment.
Teleconsultations take place via secure video and audio using the Agora platform. You agree that the consultation is recorded as a clinical encounter, that the doctor’s consultation summary note is stored against your record, and that the quality of the video session depends on your network connectivity. MacWish Medical Centre is not liable for consultation disruptions caused by third-party telecoms failures.
Home visits require an active Home Visit Subscription. You agree to provide an accurate residential address at the time of booking. The Centre reserves the right to decline a home-visit request outside the covered service area.
Where you cancel an appointment, refunds and credit handling follow the rules displayed in-app at the time of booking. Late cancellations and no-shows may consume booking credits or subscription quota.
9. Hospital referrals
When your doctor signs a referral letter through the Service, a PDF document is generated by a secure server-side function and stored in your encrypted clinical record. The referral contains only the clinical fields your doctor explicitly selects. You may request a copy of any referral concerning you at any time by contacting info@macwishmedicalcentre.co.tz.
Referral letters are signed by the issuing clinician only. The Centre has adopted a direct-sign model (no countersignature required) to ensure referrals can be issued promptly in urgent or emergency situations.
10. Payments and subscriptions
- Prices are shown in Tanzanian Shillings (TZS) and are inclusive of applicable taxes and levies.
- Payments are processed by licensed Tanzanian payment gateways (ClickPesa and others). MacWish Medical Centre never stores your full card number or mobile-money credentials; these are handled exclusively by the payment processor.
- Subscription plans currently available: Home Visit Subscription (monthly or annual), NCD Care Plan, and Family Care Plan. Recurring subscriptions renew on the cycle you select unless you cancel before the next renewal date via Settings → Subscriptions.
- Per-consultation credits, when purchased, are non-transferable, non-refundable (except for clearly erroneous charges), and expire as displayed in the app at the time of purchase.
- Refunds for clearly erroneous charges are issued to the original payment method within 14 working days of confirmation by our team.
- Credit or subscription quota consumed by a consultation that was interrupted by a network failure may be reviewed for restoration upon written request to info@macwishmedicalcentre.co.tz.
11. Doctors and clinical staff
- You must provide your current MCT registration number and expiry date during account setup. We verify this information before activating clinical-workflow access.
- You are responsible for keeping your MCT registration current. If your registration lapses or is revoked, your service-provider permissions will be suspended pending re-verification. Patient-care access will not be restored until valid credentials are confirmed.
- As a clinician, you are solely responsible for the accuracy and completeness of the clinical notes, vital-sign assessments, clinical profile entries, and referral letters you create or sign through the Service.
- You agree to use the teleconsultation and clinical-workflow features only for legitimate patient care and not to conduct consultations outside your area of competence or licensed specialisation.
- Doctor ratings submitted by patients are visible to you and to administrators. You agree not to solicit, incentivise, or coerce ratings.
- Consultation pricing and availability windows you configure in your profile are binding for appointments booked during those windows. Changes to pricing take effect only for bookings made after the change is saved.
12. AI assistants — Dorah and Nyamizi
Dorah is our AI appointment receptionist; Nyamizi is our AI clinical assistant. Both run on top of Anthropic’s Claude, accessed through our secure automation server, which enforces strict data minimisation before any patient information reaches the AI model.
Dorah and Nyamizi may occasionally produce inaccurate, incomplete, or out-of-date responses. You agree to:
- Verify any clinically consequential statement with a qualified clinician before acting on it.
- Not rely on Nyamizi as a substitute for an in-person examination, diagnosis, or prescription.
- Not use Dorah or Nyamizi to attempt to extract another patient’s information.
Conversation history is stored against your account so you and your clinician can refer back to it. You may request deletion of your conversation history at any time.
13. Women's health features
Menstrual cycle tracking and pregnancy journey data are voluntary features. Data entered into these features is treated with the highest level of sensitivity, stored separately from general clinical records, and is accessible only by you and your assigned clinician. You may delete this data at any time from within the app.
14. Notifications
By enabling push notifications, you consent to receiving appointment reminders, teleconsultation call alerts, and other service-related notifications via OneSignal. You may disable notifications at any time in your device settings or within the app under Settings → Notifications.
15. Service availability
We aim to keep the Service available continuously, but we do not guarantee uninterrupted access. Factors outside our control — including telecoms outages, mobile-money gateway interruptions, and scheduled maintenance — can affect availability. We will provide reasonable notice of planned maintenance windows where possible. MacWish Medical Centre is not liable for losses or harm resulting from temporary service unavailability.
16. Intellectual property
The Afya Hub name, the Afya Hub logo, the MacWish Medical Centre name and logo, and the Service’s code, design, content, and AI agents are owned by MacWish Medical Centre or its licensors. You receive only a limited, revocable, non-transferable, non-exclusive licence to use the Service for its intended personal healthcare purposes. Nothing in these Terms transfers any intellectual property right to you.
17. Termination
You may stop using the Service at any time and delete your account from Settings → Delete my account. Deletion is permanent and atomic across all associated records, subject to the clinical-record retention requirements in our Privacy Policy.
MacWish Medical Centre may suspend or terminate accounts that breach these Terms, are used to harm or harass another user or clinician, are obviously fraudulent, or where a clinician’s professional registration has been revoked. Where the law permits and it does not compromise security or another person’s safety, we will tell you why.
Service-provider accounts may additionally be placed in a suspended state following an escalation process that includes a formal warning, giving you an opportunity to respond before suspension takes effect.
18. Liability
To the fullest extent permitted by Tanzanian law:
- The Service is provided “as is” and “as available”, without implied warranties beyond those that cannot lawfully be excluded.
- MacWish Medical Centre is not liable for indirect, consequential, special, or punitive losses, or for loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
- Our aggregate liability for any claim arising from the Service is capped at the total amount you paid us in the twelve (12) months immediately before the event giving rise to the claim.
- Nothing in these Terms limits liability for fraud, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
19. Governing law and disputes
These Terms are governed by the laws of the United Republic of Tanzania. Any dispute that cannot be resolved through good-faith discussion between the parties will be referred to the courts of Mwanza, Tanzania. Where the dispute concerns a small consumer matter, you may instead approach the Fair Competition Commission (FCC), the Tanzania Communications Regulatory Authority (TCRA), or another competent Tanzanian authority.
20. Changes to these Terms
We may update these Terms from time to time. The version date at the top of this page reflects the most recent change. Where a change is material — for example, changes to payment terms, new service categories, or changes to liability provisions — we will notify you in-app or by e-mail at least 14 days before the change takes effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
